Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and 3ENET Media ("FaceOff," "we," "us," or "our") governing your use of faceoff.3enet.ca and all related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be able to form a binding contract to use FaceOff. If you are a minor in your province or territory, you may only use the Service with the involvement of a parent or guardian. Individual contests and events may set their own minimum or maximum age requirements ("min_age"/ "max_age"); you're responsible for meeting them before entering.
2. Your account
You're responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately of any unauthorized use. We strongly recommend enabling two-factor authentication. We may suspend or terminate accounts that violate these Terms, misuse the Service, or pose a security risk to other users.
3. Contests, entries, and voting
Each contest is created and governed by its organizer, who sets its own title, description, entry rules, judging/voting method, submission type, and (where applicable) age limits and prize terms — displayed on that contest's page. FaceOff provides the platform (entry submission, voting, results calculation) but is not the organizer of individual contests unless stated otherwise. Where a contest is a "contest of mixed skill and chance" or otherwise implicates Canada's Competition Act or the Criminal Code's lottery provisions, the organizer is responsible for structuring it lawfully (for example, ensuring a genuine skill component and clearly disclosed rules, and — for any promotional contest offering a prize — complying with applicable disclosure requirements). Vote manipulation, creating multiple accounts to self-vote, or otherwise gaming a contest's outcome is prohibited and may result in disqualification and account termination.
4. Content you submit
You retain ownership of the content you submit (entries, media, profile content, chat messages). By submitting it, you grant FaceOff a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute it as needed to operate the Service — for example, showing your entry to voters or your broadcast to viewers. You confirm you have the rights to everything you submit and that it doesn't infringe anyone else's rights or violate the law.
5. Payments, tickets, and donations
Ticket purchases and donations are processed through Stripe. Prices are shown in the currency posted at checkout. Completing a purchase creates a binding obligation to pay the stated amount. See our Refund Policy for when refunds are available. Donations made through the Service are voluntary and, unless the recipient is a registered charity and a receipt is explicitly issued, are not eligible for a charitable tax receipt.
6. Prohibited conduct
You agree not to: harass, threaten, or abuse other users; post unlawful, defamatory, or infringing content; attempt to circumvent security controls, rate limits, or age restrictions; use the Service to facilitate an unlawful lottery or scheme; scrape or automate access without our written permission; or otherwise use the Service for a purpose it wasn't intended for. We may remove content or suspend accounts that violate this section, at our discretion.
7. Live broadcasts and chat
Live event chat and broadcasts are moderated on a best-efforts basis. Content posted in real time may not be reviewed before it's visible to other users. Report abusive content or behaviour to a platform admin.
8. Sponsorship and advertising
Sponsorship and advertising features on FaceOff connect businesses with creators, contests, and events. Unless explicitly stated on the Service, sponsorship inquiries are an introduction mechanism only — any resulting financial arrangement is between the parties involved and not a transaction processed by FaceOff.
9. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by Ontario law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or that any contest, broadcast, or payout will proceed exactly as planned. Nothing in this section limits any warranty or right that cannot be excluded under Ontario's Consumer Protection Act, 2002 or other applicable law.
10. Limitation of liability
To the maximum extent permitted by law, FaceOff and 3ENET Media are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost profits, lost data, or lost contest winnings, even if advised of the possibility of such damages. Our total liability for any claim arising from the Service is limited to the amount you paid us, if any, in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot lawfully be limited, including for gross negligence or wilful misconduct.
11. Indemnification
You agree to indemnify and hold FaceOff and 3ENET Media harmless from claims arising out of your content, your conduct on the Service, or your violation of these Terms.
12. Termination
You may close your account at any time from your Profile page. We may suspend or terminate your access for violating these Terms or applicable law. Sections that by their nature should survive termination (content licence for already-published material, limitation of liability, indemnification, governing law) continue to apply after your account is closed.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date; continuing to use the Service after that date means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. You agree that any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Ontario. Nothing here removes any right you have as a consumer under Ontario's Consumer Protection Act, 2002 to bring a claim in the forum that statute preserves for you.
